These Terms of Service ("Terms") govern your use of the website at birddogops.com (the "Site"), operated by Bird Dog Operations, LLC ("Bird Dog Operations," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
The Site describes our aerial mapping, monitoring, and site documentation services. Content on the Site — including pricing, timelines, and service descriptions — is for general information only and does not constitute a binding offer. All engagements are subject to a separate service agreement, quote, or written confirmation between you and Bird Dog Operations.
Drone flight operations are conducted under 14 C.F.R. Part 107. All flights are subject to weather, airspace authorization, and regulatory constraints, which may require rescheduling without notice. Stated turnaround times are targets, not guarantees.
Our deliverables — including maps, orthomosaics, measurements, volume calculations, photos, and video — are aerial documentation for informational and project-management purposes. They are not a land survey, boundary determination, or engineering document, and are not certified by a licensed surveyor or engineer. Do not rely on our deliverables where a licensed survey or engineering analysis is required.
Prices displayed on the Site are indicative and may change. Final pricing, payment terms, and cancellation terms are set in your service agreement or written quote.
The Site and its content — text, graphics, logos, and imagery — are owned by Bird Dog Operations or its licensors and are protected by law. You may not copy, reproduce, or use Site content for commercial purposes without our written permission. Ownership and license terms for project deliverables are defined in the applicable service agreement.
You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false or misleading information through our forms, or using automated tools to scrape or spam the Site.
The Site uses third-party services, including a chat widget and CRM platform, and may link to third-party websites. We are not responsible for the content or practices of third parties. Your use of the chat widget and contact form is also subject to our Privacy Policy.
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, Bird Dog Operations will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site. Our total liability arising out of or relating to the Site will not exceed one hundred dollars ($100). Liability relating to contracted services is governed by the applicable service agreement, not these Terms.
You agree to indemnify and hold harmless Bird Dog Operations and its members, officers, and agents from claims arising out of your misuse of the Site or violation of these Terms.
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising under these Terms will be brought in the state or federal courts located in Salt Lake County, Utah.
We may update these Terms from time to time. The effective date above reflects the latest revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
